TCPA Regulatory Update Overview (January 2025)

Understanding the New TCPA Rules and Ensuring Compliance with Sierra Interactive

Introduction to the TCPA Regulatory Updates

The Telephone Consumer Protection Act (TCPA), enacted in 1991, regulates telemarketing communications, requiring businesses to obtain "express consent" before contacting consumers via phone or text. Effective January 27, 2025, the FCC introduced the "one-to-one consent rule," mandating express consent for each individual seller, closing the "lead generator loophole."

How Does This Affect You as a Sierra Interactive Client?

  • One-to-One Consent: Sierra’s platform already ensures compliance by obtaining consent specific to your business when consumers register on your website.
  • Proof of Express Consent: By January 27, 2025, Sierra will enhance lead capture processes to include detailed registration records documenting when and how consent was obtained.
  • Opt-Out Automations: Sierra automatically appends opt-out instructions to text messages and ensures opt-out requests (e.g., "stop" or "cancel") are honored.
